TERMS AND CONDITIONS

Please read the following terms and conditions fully. The ordering of products from Sun Leisure Ltd, from this website and other mediums indicates that you are in full agreement and acceptance.

The following terms and conditions apply between you (hereinafter “customer”, “recipient” or “you”) and Sun Leisure Ltd (hereinafter “Sun Leisure Ltd”, “Sun Leisure”, “online shop" or "we/us"):

PRIVACY POLICY

Information we collect about you:
We collect information about you when you are processing the order, creating an account on our website and we may collect information about you when you are taking part in promotions and competitions.
Information we may collect about you are your e-mail address, name and surname, delivery and mailing address, phone number. When you place an order we will ask you to provide your credit card details, which are not stored in our database.

Using your information:
Sun Leisure Ltd uses this information to process the order, which you placed on our website. We may use this information to tell you about important changes to our website and to manage promotions and competitions. Your personal information is safe with us and will never be released to third parties.

Marketing and research:
We may use contact information you have provided (either when placing an order through our website, by telephone or if you have provided your contact details to one of our representatives at an event) to tell you about products, promotions and special offers that may be of interest to you, by email. All customers are given the opportunity to opt-out of receiving such further information. You may do so at any time by clicking the ‘unsubscribe’ link at the bottom of the email and confirming you wish to opt out, or by contacting our Customer Services Team on the following number: 01928 727449 or email sales@sun-leisure.com

Cookies:

This website uses internet cookies. Where services are delivered on the internet, this sometimes involves placing small amounts of information on your device, for example, a computer or mobile phone. These include small files known as cookies. They cannot be used to identify you personally.

Security:

All personal information is transmitted through our secure server using SSL (Secure Socket Layer). Credit Card details are NOT stored on our server.

CONTENT ACCURACY

Sun Leisure Ltd have taken every care in the preparation of the content of this website, in particular to ensure that all prices quoted are correct at time of publishing and that all products have been accurately described. Prices are quoted in pounds sterling and include VAT, unless otherwise stated.  Packaging may vary from that shown. The weights and dimensions may vary slightly. We have made every effort to display as accurately as possible the colours of our products that appear on the website, however colours may well look different depending on customers’ monitors being used and we cannot be held liable for any slight differences in shades to actual delivered products.

ORDERING GOODS

All orders placed on this website are subject to acceptance. When confirmation of a customer’s order is received, this is to indicate that Sun Leisure Ltd has received the order. It does not indicate that a contract exists between the customer and Sun Leisure Ltd. We will indicate acceptance of the customer’s order, and hence a contract between the customer and Sun Leisure Ltd, when we send an invoice to the customer (or when we dispatch goods to the customer).  We reserve the right to refuse an order for any reason.

AVAILABILITY

All products are subject to availability and we will inform you as soon as practically possible when goods ordered are not in stock. We will offer an alternative colour or similar product or advise when the ordered product will be back in stock.

DELIVERY OF GOODS

Non bespoke goods supplied within the UK and ordered before 12pm will usually be delivered the next working day following acceptance of order, but in any event, within 14 days after the contract is entered into. Standard delivery is an all-day lead time, but if you wish to request a time specific delivery or Saturday delivery please contact our Customer Service team for advise.

If goods are not delivered within the stated delivery period, please contact our Customer Services team as soon as possible and we will deal with our couriers on your behalf. Alternatively we can supply you with a tracking number and you can contact the courier company direct.

We won’t be liable for any loss caused to you by late delivery.

Upon delivery, the customer is responsible for checking that they have received the correct number of parcels and also the condition of the parcels, before signing for them. If goods appear damaged, please state this on the delivery documentation, i.e. “Goods arrived damaged” and contact our Customer Service team as soon as possible. If you sign for a “Clean Bill of Delivery” or “unchecked”, any insurance claim you may make against the courier for damage in transit will be void. If the goods are damaged in transit please contact our Customer Services team within 24 hours after receiving the delivery of goods. Any claims after this time cannot be considered.

If for any reason there will be no-one available to accept the delivery, you can leave a signed note, which the couriers need to take as proof of delivery, instructing them to leave your goods in a “safe” place. By doing so you are accepting a “Clean Bill of Delivery” and Sun Leisure will be unable to make a claim on your behalf if the parcels are stolen or have been damaged in transit.
If the first delivery attempt is unsuccessful due to customers not being at the delivery address or not leaving a signed note for the courier company, Sun Leisure Ltd reserves the right to charge £10.00 for any further delivery attempts.

Most of our goods are delivered as individual parcels. In case of a large order or if you purchase an 8m X 4m PROTEX®50 shelter, products will be delivered on a pallet. If you require a tail lift, please specify this in the comment section or contact our Customer Service team. There will be no extra charge for requesting a tail lift.

PRICE AND PAYMENT

All prices are quoted in sterling and include VAT (unless otherwise stated). The price excludes delivery charges.

UK Delivery charges are divided into 2 categories: a) Instant Shelters, and b) any other items. These two charges might be combined in the case of purchasing goods from both categories.

a) Delivery charge of any Instant Shelters (either complete or without sidewalls) purchased through www.sun-leisure.com is £9.95 per shelter.

b) Delivery charges of any items (except for Instant Shelters) purchased throught www.sun-leisure.com are based on the value of your order:

Delivery charges to the UK (Except Orkney Islands, Shetland Islands and Northern Ireland) are:

We can ship to most countries worldwide, please contact our Customer Service team for a quote on shipping for any area worldwide not stated above. Although our web-shop system will allow placing an order with delivery outside the UK, additional shipping cost will be charged based on individual outside UK delivery quote.

The total purchase price including VAT and delivery charges will be displayed in the shopping cart prior to confirming the order.

All orders are payable in full before delivery and full Title to the goods remains with Sun Leisure Ltd until paid for in full.

Accepted payment methods: Visa, Maestro, MasterCard, JCB, PayPal, BACS and Cheques. 

Customers confirm that the credit or debit card that is being used is theirs. All credit/debit cards are subject to validation checks and authorisation by the card issuer. BACS payments require 3 working days to clear and cheques require 5 working days to clear.

RETURNS AND REFUNDS POLICY

We believe that you will be satisfied with the ordered product, but if for any reason you are not satisfied with your purchase you can exchange it for another product, or receive a refund. This excludes bespoke items.
Customers have 14 days to cancel the contract and return the goods to Sun Leisure Ltd. Sun Leisure Ltd will arrange a collection of the goods if they have already been dispatched. The customer is responsible for ensuring that all goods are returned in their original condition and packaging, and goods must be unused. Sun Leisure Ltd must be advised in writing via e-mail, letter or fax within the stated time period if for any reason the customer wishes to cancel the contract, otherwise we reserve the right to refuse the return. No requests for refunds will be considered after this period.

Once the goods are received, Sun Leisure Ltd will process the quality control checks. Sun Leisure Ltd has 30 days to process the quality control checks. If the products satisfy our quality control we will process a refund for the price which was paid for the goods excluding any delivery costs incurred by the company and a 3% handling charge within 30 days of the goods arriving back to Sun Leisure Ltd.

Goods which were used cannot be returned to Sun Leisure Ltd without a valid reason (for example a manufacturing fault). Sun Leisure Ltd reserves the right to refuse any refund if the terms & conditions were not met.
If at any point the customer decides to cancel a bespoke order (i.e. branded products, individual amendments, and inflatable structures) any payments made are non-refundable. We reserve the right to refuse a request for any refunds when manufacturing bespoke work, which have been approved and “signed-off” on the Customers instructions.

FAULTY OR DEFECTIVE ITEM

In case the goods are faulty or defective, Sun Leisure Ltd must be notified within 48 hours of receiving the goods. We might ask you to provide photographic evidence of the fault or to have the item returned to us for inspection. This will enable us to make a decision to either replace or repair the item. Sun Leisure Ltd has 30 days to make a decision whether the item is to be replaced or repaired.

WARRANTY

We offer a 12 months warranty on our complete product range. We also offer extended warranties on our PROTEX® range of instant shelter frames: 24 months on the PROTEX®40 frames and 36 months on the PROTEX®50 frames.
On top of this we also offer our unique Lifetime Bracket Warranty, meaning that any instant shelters purchased from us are covered for accidental damage & breakage of any joints or brackets and these brackets will be supplied free of charge. (Proof of purchase required and we reserve the right to charge delivery on these spare parts).

Sun Leisure Ltd  warranty does not cover damage caused to its products by adverse weather, wind, rain or other forces of nature, and including accidents, improper assembly or disassembly or adjustment during set-up or take down, or any abuse, misuse or neglect by the user.

Our structures are not permanent structures and should not be left unattended for prolonged periods of time. We do not advise you assemble or disassemble the structure during adverse weather conditions. Damage caused by incorrect use or incorrect anchoring of structures in adverse weather or through improper use will not be covered by our warranty.

WARRANTY CLAIMS

Any damage claims made under warranty must follow this procedure:

The Customer must notify Sun Leisure Ltd immediately and not later than 48 hours after taking delivery of the goods, by email with a full description of the damage, supported by digital photographs. Sun Leisure Ltd has 7 days to respond to this e-mail and might request the customer to repack the defective part(s) and notify Sun Leisure Ltd when the goods are ready to collect. Once the defective part(s) are examined, Sun Leisure Ltd will arrange for redelivery of a replacement part subject to stock availability, provided that goods have not been used or mistreated in any way by the customer. If, in Sun Leisure Ltd.’s opinion there is evidence that the goods have been used and that the damage has been incurred as a result of misuse or any other situation which is not covered by warranty, we reserve the right to either accept the goods for full replacement, offer a replacement part on payment of a 50% repair charge or decline the acceptance of the goods and return them to the customer in their damaged state. Under these circumstances the customer will be liable for the carriage cost of collection and return.

LIMITATION OF LIABILITY

Sun Leisure Ltd attempts to ensure that the information available on our website at any time is truthful and accurate. However, we cannot guarantee that it will be fault-free and uninterrupted. Sun Leisure Ltd does not accept any liability for any losses or claims arising from any inability to access the web site, any interruption in the conduct of any transaction or any failure to complete a transaction. All liability, in negligence or otherwise, for any loss arising from the use of these particulars is hereby excluded.

In particular, we disclaim all liabilities in connection with the following:

•    incompatibility of the www.sun-leisure.com site with any of your equipment, software or telecommunications links
•    technical problems including errors or interruptions of the www.sun-leisure.com site
•    unsuitability, unreliability or inaccuracy of the www.sun-leisure.com site
•    inadequacy of the www.sun-leisure.com site to meet your requirements

OWNERSHIP OF THE RIGHTS

All rights, including © Copyright and ® Trademarks within this website are owned by Sun Leisure Ltd. Any unauthorised use of this website or its contents, including copying, storage, or use of trademarks is prohibited without the express permission of Sun Leisure Ltd. You may not modify, distribute or re-post any contents of the website for any purpose without our express permission.

LAW JURISDICTION & LANGUAGE

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

CHANGES TO LEGAL NOTICES

Sun Leisure Ltd reserves the right to amend these terms and conditions from time to time and we recommend that you view them on a regular basis.

FORCE MAJEURE

Sun Leisure Ltd shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, terrorism, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and that  Sun Leisure Ltd shall be entitled to a reasonable extension of its obligations.

SEVERANCE

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
